Purchasers and users assume all risk, responsibility and liability for use of these products, including any resulting loss or damage to persons or property. The purchaser or user assumes the responsibility for knowing and obeying all traffic laws and regulations in their city, county, state, or country. I understand and acknowledge that skateboarding involves inherent risks, dangers, and hazards which can result in serious personal injury or death. I hereby unconditionally release from any and all liability and agree not to sue, to indemnify and hold harmless OS3, their representatives, agents, affiliates, partners, officers, directors, and employees of and from any claims, demands, actions for damage, personal injury or death to myself, or to any person or property, arising out of, or in connection in any way with my participation with in skateboarding, or any other activities with equipment or accessories purchased from OS3. I further recognize and acknowledge that the risk inherent in the sport of skateboarding can be greatly reduced by wearing safety equipment, riding within my abilities and using common sense at all times. We disclaim all representations or warranties, express or implied, made to you or any other person, including without limitation, any warranties regarding quality, suitability, merchantability, fitness for a particular purpose or otherwise of any services or any goods provided, as allowed by law. So far as permitted by law, OS3 shall not be liable to any user of this website or third party for any claims, damages, costs, losses, expenses or liabilities whatsoever, arising out of or in connection with or related to the use of this website or the information on it. I have read and I understand this agreement and all of its terms. I am entering into this agreement freely and voluntarily and I agree that it is and shall be binding on me, my heirs, assigns and legal representatives. I understand that I am entering into a legally binding sales contract with an explicit stipulation not to sue OS3 except for gross negligence and intentional misconduct. I further agree that any claim or suit that I may bring for any reason against OS3 shall be submitted to the jurisdiction of the state or federal court in the state in which OS3 is located and no other jurisdiction and shall be governed by the laws of that state. I agree that if any portion of this agreement is determined to be unenforceable by a court of law, all other parts of the agreement shall remain in full force and effect. Typographical Errors In the event that a OS3 product is mistakenly listed at an incorrect price, OS3 reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. OS3 reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, OS3 shall issue a credit to your credit card account in the amount of the incorrect price. |
